Supreme Court is wise to protect Nupur Sharma from arrest. Exactly the same immunity must be given to Mohammed Zubair as well, and many others faced with Section 295A FIRs for ‘hurting sentiments’. This sham of a law has only been misused for nearly a century, and should now go.

Pass orders, don’t editorialise — SC comments on bails are mere homilies

Supreme Court’s broadsides against indiscriminate arrests and bail denials are well-appreciated. But judges should pass orders, not editorialise. They shouldn’t look helpless when SC guidelines on arrest in Arnesh Kumar vs State of Bihar case are violated with impunity. Bail-is-rule assertions are mere homilies when subordinate courts pay little heed.
