The Court merely directed that there can be no automatic arrest, without a preliminary enquiry, or denial of bail in such cases. Then the great drama of overcoming the judgment by issuing an ordinance. What has happened in this case is what the Act is worth on the ground, especially in Mr Bisht’s Uttar Pradesh. The minor girl’s complaint of having been violated by Kuldeep Sengar should have led to his immediate arrest, instead, see what happened for the next one year, including her father’s brutal murder. Sengar is still a valued member of the party, will get its ticket – or perhaps his wife will – and join a large contingent of lawmakers who have serious charges of rape and murder pending against them. Not the best way to woo the Dalit vote.
