Supreme Court allows RSS to march in Tamil Nadu, dismisses state appeal

In October 2022, RSS sought state government’s permission to hold marches to celebrate Gandhi Jayanti and ‘Azadi Ka Amrit Mahotsav’.

New Delhi: The Supreme Court on Tuesday dismissed an appeal by the Tamil Nadu government against a Madras High Court judgment which allowed the Rashtriya Swayamsevak Sangh (RSS) to carry out route marches in the state.

A bench of Justices V. Ramasubramanian and Pankaj Mithal passed the verdict that will now see the RSS take out marches without any restrictions.

In October 2022, the RSS sought the state government’s permission to hold marches to celebrate Gandhi Jayanti and “Azadi Ka Amrit Mahotsav” – a central government initiative to commemorate 75 years of Independence.

The state government refused and the Hindu organisation moved the high court.

In November, a single bench gave RSS permission but with conditions such as holding the marches indoors or in enclosed spaces.

A division bench of the Madras High Court, however, lifted these restrictions on 10 February and emphasised the “importance of protests in a healthy democracy”.

The state government then challenged this verdict in the Supreme Court, which was dismissed Tuesday.
