A bench of Justices B R Gavai, A S Bopanna and Dipankar Datta issued notice to the Gujarat government on the appeal filed by Setalvad against the Gujarat High Court order.
Setalvad was arrested by the Gujarat Police on 25 June, 2022, on charges of conspiring to falsely implicate innocent people in connection with the 2002 Gujarat riots.
Setalvad was granted bail by Supreme Court last September in a case pertaining to alleged fabrication of evidence to frame innocent people in 2002 post-Godhra riots cases.
The court said the prosecution failed to prove that the two accused were part of the mob that 'attacked and killed' 14 people in Vadodara’s Best Bakery during 2002 Gujarat riots.
