Women and Child Development Minister’s statement is significant because activists have been highlighting that there is a pushback against women-centric laws.
New Delhi: Months after women’s rights activists said that the Supreme Court was diluting Section 498-A of the Indian Penal Code, Women and Child Development Minister Maneka Gandhi too seems to have joined the anti-dowry law hysteria, calling the law a “strange” one.
Speaking at the 25th anniversary celebration of the National Commission for Women Wednesday, Gandhi said the commission is actively working for the welfare of female prisoners who are denied any dignity the moment they become prisoners. Many of them are behind bars due to crimes they may have committed in self-defence, or because of the “strange 498-A, which puts even a husband’s relatives behind bars after a complaint is filed”.
Advocate Vrinda Grover argued that the minister was being critical of the criminal justice system as a whole. “The minister would be well aware that nobody is arrested under 498-A without conviction, which happens through a court of law… It’s not as though women file complaints in the police station, and the arrest immediately takes place,” Grover said.
Maneka Gandhi’s statement is of significance since activists have been highlighting for some time that there is a pushback against women-centric anti-dowry and anti-rape laws.
Last year, the Supreme Court issued a set of guidelines aimed at arresting a husband and his relatives for cruelty against his wife, in order to prevent the misuse of the anti-dowry law. While the apex court later said that it would reconsider its earlier ruling – without staying it – ThePrint reported that states are setting up family welfare panels aimed at examining domestic violence allegations despite the SC move to reconsider its order.
Moreover, last year, a senior bureaucrat in the government wrote to the WCD ministry, arguing that there is rampant misuse of women-centric laws, including Section 498-A, by women, and it must be checked.
Dismissing these fears, Grover said: “Cases of domestic violence – both mental and physical – continue to be very pervasive and widespread. It would be good if the WCD ministry could focus on changing these numbers (of cases of violence against women).”

Seems… Advocate Vrinda Grover is afraid of her practice and business… There are many lawyers in lower courts across the country for whom 498A is bread and butter…
A complaint is basically written and filed by the lawyer and not by a woman or her Parents… After SC ruled “No arrest in 498A:… Ingredients like attempt to murder, Rape in marriage and unnatural sex were included in complaints so that it can bypass SC ruling and immediate arrest can happen.. It is basically Lawyers who ruin two lives and cause mental agony to parents of both sides…
Above all… They make court to functions in routine manner and mechanically, not only in 498A but also in other cases… It is basically lawyers who are responsible for huge backlog of cases delaying justice to the needy one…

Kamini Lau, Additional Sessions Judge , Delhi, said on 3rd March,2010 :”I am compelled to observe that IPC 498A provision has become consummate embodiment of gross human rights violation, extortion and corruption and even the Apex Court of our country had acknowledged this abuse and termed it as legal terrorism”
Now a days 80% of the women are working and earling. About 40% reservation are for ladies in the employment. So Its my humble request that there must be some changes in crpc 125 and simaltaniously the cases which are on going in the different court of justice, the court orders the double or tripple maintenance amout. or such a amount that a men cant or cant able to pay the amount and at the result he has to go to the jail and after coming from jail he has to pay maintenance too.
So Its my humble request that looking to the current situation of the women in the nation the maintenance amount of the law must be change so that we can save the family or save the life of the men in the Nation .

Mam, One thing i like to say that in current time the law which are ment to protect and give justice to the people is actuelly killing the humanbeings in the nation. every 7 to 8 minut one person commit suicide in our nation. Marriage is an Institution is curropted and Marriage is now becomes a big Industry for money making. Police, Advocate and in the Court of Justice too making people baggers. So it is my humble request to you that a big changes to be needed in the Family law to protect family and men too. If it is not done the future of the country is not so good and people wont prefer to do marriage at all.
