Palghar, Jul 26 (PTI) A motor accident claims tribunal (MACT) in Maharashtra’s Palghar has awarded a compensation of Rs 1.06 crore to a 31-year-old man, a former student of hotel management, who was rendered paraplegic and bedridden following a road accident on the Mumbai-Ahmedabad Highway in 2017.
MACT member A R Rahane directed the owner of a trailer that rammed into the victim’s car and its insurer, New India Assurance Company Limited, to jointly and severally pay Rs 1.06 crore, along with 6 per cent interest per annum from the date of application, to the victim, Rishabh Vijaykumar Chopra.
According to the claim petition, Rishabh, who was a student of hotel management, was travelling with his parents from Vapi (Gujarat) to Mumbai in a car driven by his father on December 31, 2017, when a speeding trailer rammed into their vehicle near Haloli village.
The impact caused the car to tumble three to four times onto the opposite side of the road, it stated.
While his mother succumbed to her injuries on the spot, Rishabh suffered severe trauma and lower body paraplegia, leaving him 70 per cent permanently disabled and bedridden, the plea stated.
The insurance company contested the claim, alleging contributory negligence by the victim’s father and disputing the future earning capacity and extent of medical expenses.
However, the tribunal rejected these arguments, pointing out that police had filed a chargesheet solely against the trailer driver for rash and negligent driving.
“Filing of chargesheet prima facie points towards his complicity in driving the vehicle negligently and rashly,” it observed.
The tribunal directed the opponents to deposit the full amount within two months. PTI COR ARU
