HC seeks explanation over maintenance to divorced wife after remarriage

Prayagraj (UP), Jul 9 (PTI) The Allahabad High Court has sought an explanation from a court in Jhansi over the grant of maintenance to a woman who had re-married after getting divorced.

Justice Praveen Kumar Giri passed the order on July 7 while hearing a petition filed by the woman’s former husband, challenging an order of the additional principal judge in the Jhansi Family Court, directing him to pay Rs 10,000 per month as maintenance to his wife.

The court issued a notice to the woman and said, “Harish Chandra, Additional Principal Judge, Family Court, Jhansi, is directed to submit his explanation as to why despite disclosing the fact of the second marriage of the applicant (wife), the husband was directed to pay Rs 10,000 to the wife.” The counsel representing the former husband of the woman told the court that “the parties were granted a divorce on July 30, 2025, by the Additional Principal Judge, Family Court, Jhansi. It was submitted that the husband-revisionist had filed an appeal against the divorce decree. However, just after a month of the decree, the wife had remarried”.

“The fact of the second marriage of the wife was disclosed on an affidavit. However, despite such disclosure, the additional principal judge, Family Court, Jhansi, directed the payment of Rs 10,000 to the wife and Rs 5,000 to the son. Though, as per law, after remarriage, a wife is not entitled for maintenance,” he submitted.
