Supreme Court asks RBI to disclose annual banks inspection report under RTI

The Supreme Court bench said that the RBI is 'bound under the law' to disclose information relating to banks under RTI.

New Delhi: The Supreme Court Friday directed the Reserve Bank of India (RBI) to disclose information pertaining to its annual inspection report of banks under the Right to Information (RTI) Act unless they are exempted under law.

A bench headed by Justice L Nageswara Rao also directed the federal bank to review its policy to disclose information relating to banks under RTI, saying “it is duty bound under the law”.

The bench, which did not go ahead with contempt proceedings against the RBI, made it clear that it was giving a last opportunity to it to comply with provisions of the transparency law.

The bench said it would have taken a serious view to the refusal of RBI to part with information under RTI.

“Any further violation shall be viewed seriously,” the bench said.

In January this year, the top court had issued contempt notice to RBI for not disclosing annual inspection report of banks under RTI.

Earlier, the apex court and the Central Information Commission, both had held that the RBI cannot deny information to an information seeker under the transparency law unless the material is exempted from disclosure under the law.

The RBI, in its defence, had said that it cannot disclose information as the annual inspection report of the bank contained “fiduciary” information as defined under the transparency law.

The bench was hearing a contempt petition filed by RTI activist S C Agrawal against the RBI.

  2. There is a difference between someone who has made several attempts and got in by virtue of his caste and the present case where he has come through merit. In my service there was a bright supervisor who was SC. However none of the “higher caste” lower employees took any instructions from him!

  3. For 25 yrs, Raju was not discriminated …his promotions went thru. At the first hurdle he blames the system…..he wants it smooth thru life. Think of others who are deprived all the time

  4. Sir, u r a PhD from “Tata Institute of Social Sciences”, Mumbai, & also a visiting Fellow at “Cambridge University, UK”. Not all people manage to get such a “high level” education.
    Being so “learned” why u want ur promotion on the basis of “SC/ST category” ??
    No Sir, it’s u who is “discriminating” ur self from your own fellow officers (batch mates), who have been working from years in civil services as you with the same dedication & hardwork.
    It’s u who got every thing from education to job decorated on golden plate of “reservation”. And now again u want ur promotion not on seniority basis but on the basis of reservation.
    Now who is discriminating whom?
    #ThePrint ur all reports r biased & bigotic. Have u ever gone to the details in thousands of promotions r hindered of thousands of people from 15- 20 yrs in govt offices beacuse they belong to ” upper caste”.
    But this truth u will never debate because this dosent suits ur ‘agenda’.

  5. I don’t know why ppl always play victim card.He never thought how many general deseving class ppl wud have not got job bcz of his reserved status. Despite all benefits they wud still complain…if u have guts ask ur kids not to take reservations so that someone from ur own caste who is actually left out can get a chance

  6. This is bitter reality of so called Great hindu caste system. We talk about merits but reality is whole life of “hindu” man depends upon just “caste” not his ability or his academic status. Shame on being hindu only because of this caste system
