Death in the line of duty: How states allocate compensation for families of slain personnel

New Delhi: Last week, assistant sub inspector of Delhi Police, Shambhu Dayal, was stabbed multiple times in Mayapuri area by a mobile-snatcher in full public view when he tried to arrest him. The video went viral on social media. Dayal succumbed to his injuries Sunday.

The Delhi government Wednesday announced an ex gratia of Rs 1 crore to the bereaved family. Senior officers of the Delhi Police say an additional compensation will be given to the family by the police department as well.

So what are the various categories under which the Delhi Police gives compensation to the families of police personnel dying in the line of duty?

According to documents accessed by ThePrint, the police welfare department’s categories for compensation are based on the cause of death in the line of duty: Rs 25 lakh for death occurring in the course of performance of duties attributable to acts of violence by terrorists, anti-social elements etc.; Rs 35 lakh for death due to enemy action in international war or border skirmishes, action against militants, terrorists, extremists etc; Rs 30 lakh in case of death in the line of duty involving gallantry caused solely and directly by external violence; and Rs 25 lakh is given to the family to when a police personnel is martyred while performing government duty.

Additionally, if the personnel had an Axis Bank account, the family is entitled to insurance and benefits as per the length of service and rank of the deceased.

“The recommendations of the deputy commissioner of police under whom the deceased personnel was on duty, is sent to a special board comprising special commissioners of police and other top officials who then decide the category under which the compensation is to be granted,” a senior Delhi Police officer told ThePrint.

“The compensation granted to the bereaved family by the state government is at its  discretion,” the officer said.

Rules on compensation for police personnel who die in the line of duty varies across states.

In West Bengal, the compensation depends on the zone they were posted in. A senior West Bengal police officer said, “The compensation for the kin of a police personnel dying in the line of duty in a Naxalite zone is different from that of one dying in some other zone.”

For those killed in action in an extremist or Naxalite zone, the amount is around Rs 10 lakh. Additionally, a senior police officer said, the family is given a government job. For personnel dying in the line of duty in other areas, the compensation is Rs 5 lakh. The amount is provided from the state police department budget. There is also an additional compensation in the form of insurance in a tie-up with the State Bank of India under accidental death policy, said officers.

In Assam, the compensation given to families of police personnel who die in the line of duty, making “supreme sacrifice in extremist action”, is Rs 50 lakh.

The amount is Rs 10 lakh for the family of other personnel dying in the line of duty. In December last year, Assam Chief Minister Himanta Biswa Sarma announced that the state government will provide employment to family members of 400 cops martyred since 1985.
