Calcutta HC asks appropriate bench to hear Abhishek Banerjee’s plea over alleged probe leaks

Kolkata, Oct 8 (PTI) The Calcutta High Court on Thursday released a petition filed by Mamata Banerjee-faction TMC MP Abhishek Banerjee alleging that investigating agencies were leaking information related to cases against him to the media.

Justice Krishna Rao held that his court did not have the jurisdiction to hear the petition, which concerns alleged police inaction or overaction.

The judge granted liberty to Banerjee to mention the matter before the appropriate bench of the high court having the jurisdiction to hear it.

Banerjee’s lawyer submitted that the MP is under investigation in connection with certain FIRs and has a right to a fair probe.

The lawyer alleged that a smear campaign was being carried out against the three-time Diamond Harbour MP through the leaking of information related to the investigations, thereby affecting his right to a fair probe.

He submitted that investigating officers cannot disclose details of an ongoing investigation to the media and pointed out that an accused is presumed innocent until proven guilty.

The lawyer sought directions to the investigating authorities to refrain from making statements or leaking information that could affect Banerjee’s reputation.

The court, however, held that it did not have the jurisdiction to hear the matter and directed the petitioner to approach the appropriate bench. PTI AMR MNB
