SubscriberWrites: Uniform civil code — a conflict between religion, ideology & gender justice

Seeing UCC just through the lens of religion or gender, will be a myopic view in the nation's history and in its future building exercise.

Religion is based on either one book or on multiple books considered as words of God and most near to the truth while Constitution defines a Nation and idea is to promote a Nationhood. Most Religion followed today are few centuries old and while in human spirit they make sense even today, a common man’s life is runed by the constitution of the country to which he or she belongs. At the time of fear Religion usually wins while at the time of prosperity Justice should win. The Uniform Civil Code debate has few points for and few against which make it interesting. The points in favour are it impact to a large extent a religion with a population of 18 Crore approximately ( 14% of India’s Population) and thus roughly 9 Crore females on an assumption of 50:50 split of sex ratio and if India has to move towards a progressive era of prosperity it cannot neglect the rights and Justice of the female gender and 9 crore females ( 6% population of India ) cannot be left to “Shariat Application Act of 1937” yes you read it right an Act under Constitution which is currently dictating today’s country debate. The Good thing about a Constitution is that it can be modified as per the need of the time to make it relevance and 2023 of India has come a long way since 1937 ( Roughly 86 years), take another example of a prosperous and generally considered a Happy State in India “ Goa” A place where every one from a teenager to old person aspire to go has Uniform Civil Code ( Portuguese Civil Code Successor ) The people who want a true secular world should promote a world not only secular in terms of religion but even each gender having justice and pluralistic credentials. Timing can be a point of debate here but in real sense a great time never comes unless and until everyone start believing in astrology and the beauty of a constitution is that it can evolve over time, a UCC of 2023 can always be modified with a UCC of 2045 , twenty years down the line.

Once UCC is a reality future Government can bring UFC ( Uniform Finance Code ) which can put 40% kind of tax on Inheritance which in todays India is not possible due to lack of UCC but a reality in many prosperous western countries. Surely UCC will give some advantage to few political parties in short term and swing the vote in either direction but as most of us can see it will be a reality sooner than we can anticipate so idea should be to contribute to making it as one of the solid robust foundations of a Nation. Once we get away from the issues which are stuck to past debates, it will open up the minds and times of billions to look ahead and create something for the future else we will be stuck in funny gossip stories of How a Bollywood “He Man” married second time by converting from one religion to another and then back to his original religion. The Prime Objective of Religion should be to promote a strong Brotherhood and Constitution prime objective is to make a stronger Nationhood, let both the crucial pillars of a common citizens life do their core job respectively and not interfere with one another.
