Thane, Jun 20 (PTI) The Motor Accident Claims Tribunal (MACT) in Maharashtra’s Thane has awarded a compensation of Rs 30.20 lakh to the family of a 33-year-old man, who died in the district in a road accident five years back, and maintained that there was “negligence” on the part of the deceased as well.
The victim, Sikandar Umesh Singh, died after a speeding car rammed his motorcycle on the Mumbai-Nashik Highway at Kongaon village, Bhiwandi on August 8, 2021.
In its June 17 order, the tribunal said, “The deceased was changing lanes at the time of accident. It was the duty of the deceased to take turns with care and caution and by observing traffic. But there is no evidence on record to show that the deceased took turns after taking all precautions. Thus, there is contributory negligence on the part of the deceased”.
It directed the car owner and private insurer to jointly pay a compensation of Rs 30,20,960 considering the contributory negligence of the victim. PTI COR NP
