New Delhi, Sep 22 (PTI) A Delhi Motor Accident Claims Tribunal has awarded Rs 30.26 lakh compensation to the parents of a 21-year-old man who died after his motorcycle was hit by a truck in Ghaziabad in 2019.
Presiding Officer Vijay Kumar Jha was hearing a claim petition filed by the parents of Saksham Pandey and directed United India Insurance Company Ltd to pay the compensation.
In an order dated September 17, the tribunal said, “It is held that the petitioners have been able to prove on the basis of the preponderance of probabilities that the accident had occurred due to rash and negligent driving of the offending vehicle that resulted in fatal injuries to the deceased.” According to the prosecution, Pandey was returning home from office when his motorcycle was hit by a truck near Hindon Bridge around 5 am on May 1, 2019. He died on the spot.
The tribunal rejected the testimony of a purported eyewitness, Hare Krishna Mishra, who was the deceased’s maternal uncle, after finding material contradictions in his statements.
The tribunal held that negligence was proved through the FIR, site plan, post-mortem report, photographs and the investigating officer’s testimony that the truck had struck the motorcycle from the side. It also noted that the truck driver did not enter the witness box to explain the accident.
The tribunal assessed Saksham’s monthly income at Rs 19,288 and awarded Rs 30.26 lakh compensation to the family under various heads. PTI SKM NB
