Justices Rajiv Shakdher & C Hari Shankar delivered split verdict on exception to Section 375 of IPC, which exempts husband from prosecution for forcing wife to have intercourse.
The petitions had challenged the constitutionality of the marital rape exception under Section 375 IPC (rape) on the ground that it discriminated against married women.
Justice Shakdher held that the exception for marital rape in IPC is unconstitutional, while Justice Shankar disagreed, saying exception is based on ‘intelligible differentia’.
In affidavit before Delhi HC in case of 2018 robbery and murder, UIDAI says it’s against the Aadhaar Act to use biometric information collected under the law for identifying criminals.
