This is the real threat to Supreme Court and the judiciary – not what its four learned Judges are trying to make us believe through a press conference and now with the letters. that is why a National Judicial Service is a must for appointment to higher judiciary. Once it happens, the ‘son’-stroke will be muted and like the Civil Services the merit will come to the fore and then we will see that sons-of-the-soil and not sons-of-the-judges/lawyers will hold right positions.
My Father-in-law and his brothers along with his father and other members of family had to migrate in 1930s from Palakkad,Kerala as they had filed a case againt the then Raja as the Raja had felled a tree from the family property for personal use without permission.and the case one of the earliest cases at Madras court ruled in Raja’s favour.I wish to get to know about it and give justice for the forced migration done.
Dr.Ambedkar would have been a very SAD man today .Framers of our constitution must of dreamt of ushering in a society where once Caste and religion become inconsequential.
But see where have we reached.Your Caste and religion are entered immediately at birth. Even a LKG kid is made aware of his or her caste.
Our politicians have attached a premium to few castes based on their Vote Bank calculations .
So now it’s fashionable to flaunt once Dalit or Minority Status whenever things don’t go the way you want .
The 1989 Act is grossly abused by the creamy layer using the compensation offered by the Government to buy the witnesses. This certainly compromises the fundamental right of the accused. The Act is abused to hide the misdeeds of the Complainant. The Court has corrected the Dowry Act so should this atrocious act. I have narrated the above as personal experience. Private complaint was filed as I opposed encroachments on my Plot and since 2013 there’s no progress. Complainant and witnesses don’t turn up though we (entire family) have to be present on every date, else NBW is issued.
I am a practising Advocate in Mumbai and I agree with what the author stated with regard to the open bias system followed in our judiciary, the hierarchy associated with the chamber and the nepotism that prevails in our judiciary.
I am central govt officer.l appeared in my case in person before CAT and high court where sr advocates were my opposite side but I won case at both places .As such allegation of face value in judiciary only amounts nothing more than to hide one’s own incompetence
Mostly you right. But face value judgment is also a fact.
The matter brought out on the biased approach of judiciary at all levels is really painful and heart burning. Is there anyway to withstand unitedly irrespective of language region colour.
Hope our concern will have to be raised and raised again to wake them up against discrimination of any type .
