New Delhi, Aug 20 (PTI) Chief Justice of India Surya Kant has said that the Supreme Court’s Samadhan Samaroh initiative aims to resolve pending cases through mediation in a manner that leaves both parties with a feeling that they have won.
The Samadhan Samaroh is part of the Supreme Court’s efforts to use mediation and other forms of consensual dispute resolution to address case pendency while enabling parties to arrive at mutually acceptable settlements.
In an interview with Akashwani’s News On AIR, the CJI said litigants suffer considerable stress during judicial proceedings and the initiative seeks to provide them a mutually acceptable resolution.
“Applicants suffer from huge stress during judicial proceedings. The focus is to ensure that both parties leave the court with a feeling that they have both won,” he said.
The Samadhan Samaroh, a nationwide mediation-driven exercise aimed at amicable and consent-based resolution of cases pending before the Supreme Court, began on April 21 and will culminate in a Special Lok Adalat from August 21 to 23.
“We have organised the Samadhan Samaroh in the Supreme Court from August 21 to 23. Through this initiative, we aim to reduce the pendency of cases in the Supreme Court through mediation and mutual agreement,” Justice Surya Kant said.
He said the initiative would include resolution of cases through mediation benches, gram panchayats, conciliation and community mediation.
The CJI said he had constituted a five-member committee of Supreme Court judges for the initiative, which worked with legal authorities at the national, state and district levels to identify cases that could be resolved through mediation.
The cases include family disputes and motor vehicle accident claims, while commercial litigation involving several companies has also been included.
“There is also an effort to resolve land acquisition disputes by including them in the initiative,” he said, adding that cases relating to income tax had also been taken up and the effectiveness of their resolution would be assessed.
The aim is to settle cases that can be resolved through mediation, the CJI said.
“The Supreme Court is the highest court of this country, and I am confident that many cases will be resolved under this initiative,” he said.
Justice Surya Kant said a litigant approaches the Supreme Court with a “last hope” and expressed confidence that the initiative would help deliver justice in a large number of cases. PTI SKM PKS SKM KSS KSS
