New Delhi, Sep 23 (PTI) The Supreme Court Bar Association (SCBA) on Wednesday extended its support to the Coordination Committee of All District Courts Bar Associations of Delhi, which has been protesting against recent amendments to the Central Motor Vehicles Rules regarding the mechanism to dispose of traffic challans.
“The SCBA has taken note of the concerns raised by the Coordination Committee regarding the recent amendment to Rule 167 of the Central Motor Vehicles Rules, 1989, concerning adjudication of traffic challans,” a letter issued by the association said.
The letter signed by the association’s secretary, Pragya Baghel, said the SCBA extends its support to the committee and endorses the concerns raised by it regarding the amended mechanism, particularly the adjudication of contested traffic challans by executive and departmental authorities and the requirement to deposit 50 per cent of the challan amount before approaching a competent court.
“The issues raised by the Coordination Committee concern important questions relating to access to justice, availability of an effective judicial remedy and the proper exercise of judicial functions. Any procedure which may restrict or make access to a judicial forum burdensome requires careful reconsideration and consultation with all stakeholders, including representatives of the Bar,” the letter said.
It requested the government to give due consideration to the issues and reconsider the amendments after appropriate consultations with the bar.
The coordination committee issued a circular on Tuesday, stating that member advocates will organise a peaceful march to the lieutenant governor’s house on September 24 to protest against the recent amendments.
The circular further said that there will be a “complete abstention from judicial work” on Thursday.
Lawyers abstained from work across all seven district courts of Delhi on Monday to protest against the amendments. PTI MNR RC
