Bengaluru, Aug 13 (PTI) The Karnataka High Court on Thursday dismissed a petition filed by actor Darshan, an accused in the Renukaswamy murder case, challenging a sessions court order that refused to permit him to file objections to an application by co-accused Pradosh Rao seeking pardon by turning an approver.
The petition was filed by Darshan, the second accused in the case, seeking quashing of the order passed by the 58th Additional City Civil and Sessions Court here on August 10.
Rao is the 14th accused in the Renukaswamy murder case.
Justice M Nagaprasanna, who heard the criminal petition, passed the order after hearing senior advocate Hasmath Pasha, appearing for Darshan, and Special Public Prosecutor P Prasanna Kumar.
The HC made it clear that a co-accused has no right to make submissions when a court is considering an application filed by another accused under Section 306 of the Code of Criminal Procedure (CrPC), 1973, seeking pardon and permission to become an approver.
It also took note of the prosecution’s submission that the High Court had earlier dealt with the rights of a co-accused under Section 306 of the CrPC and that the Supreme Court had already dismissed a petition challenging an order passed in connection with Yogeshgouda murder case, involving accused Vinay Kulkarni, a legislator.
The court dismissed Darshan’s petition, observing that the order passed in the Yogeshgouda murder case relating to granting approval to an approver and the subsequent proceedings would also apply to the present case.
Darshan and his friend actress Pavithra Gowda are among the 17 accused in the Renukaswamy murder case. He is currently lodged in jail under judicial custody. PTI KSU SA
