Gurugram: Representation submitted seeking demolition of ‘illegal commercial hub’ on govt land

Gurugram, Jun 30 (PTI) A fresh representation seeking demolition of an alleged illegal commercial cluster on government land here in Sector 42 has been submitted to the primary government authorities, including Gurugram Metropolitan Development Authority (GMDA), with the complainant citing recent Supreme Court directions mandating strict action against unauthorised constructions.

Alleging continued inaction despite official surveys, restoration orders and judicial directions, a city resident, Devendra Kumar Agrawal, has sought immediate eviction and demolition of “illegal commercial hub” operating on government land near Golf Course Road.

According to the representation, shops, eateries, meat outlets, courier offices, scrap dealers, pharmacies and construction material depots have encroached upon government land falling under multiple khasra numbers. They are functioning without sanctioned building plans, licences or mandatory statutory approvals, as per the representation.

It states that a GMDA survey on June 9, 2025, identified unauthorised shops in Khasra nos. 535, 536, 537, 538 and 540 near Krishna Hotel opposite Global Foyer Mall.

It further claims that GMDA issued a restoration order on January 13, 2026, directing demolition and restoration of the land, but alleges that the order has not been enforced.

Agrawal has also referred to proceedings before the National Green Tribunal, which directed the Haryana State Pollution Control Board to examine complaints regarding environmental violations after following due process. The petitioner, however, has alleged that effective action is still awaited.

The complainant has relied heavily on the Supreme Court’s orders in the Loganathan vs State of Tamil Nadu case, which directed municipal bodies across the country to identify land-use violations and take effective enforcement measures.

The representation also cites the Supreme Court’s judgment in Rajendra Kumar Barjatya vs UP Avas Evam Vikas Parishad, which held that illegal constructions cannot be regularised merely because they have existed for a long period and should be dealt with “an iron hand.” Seeking urgent intervention, the complainant has requested the Municipal Corporation of Gurugram (MCG), Haryana Shahari Vikas Pradhikaran (HSVP) and GMDA to demarcate the land, remove encroachments and demolish all unauthorised structures in compliance with the Supreme Court’s directions.
