Extortion FIR against woman who accused Haryana BJP chief Badoli & singer Rocky Mittal of gang rape

Gurugram: In a shocking turn of events, Haryana Police have booked the woman, who accused Haryana Bharatiya Janata Party chief Mohan Lal Badoli and singer Rocky Mittal of gang rape in Himachal Pradesh’s Kasauli, along with three others, for alleged honey-trapping.

Panchkula Police have lodged an FIR against the complainant in the gang rape case, another woman, Amit Bindal, a businessman and politician—who, according to the FIR in gang rape case, had accompanied the woman to Kasauli on the day of the alleged incident—and an unidentified individual.

Meanwhile, over a month and a half after registering an FIR against Badoli and Mittal for the alleged gang rape of the woman in Kasauli, the Himachal Pradesh Police have filed a cancellation report before the court. Solan Superintedent of Police Gaurav Singh told media persons that the police did not find any evidence to pursue the case further.

The Print has accessed a copy of the FIR registered Wednesday at the Sector 5 Police Station in Panchkula, based on a complaint by Mittal. The alleged victim and others have been booked under Sections 308 (1), 308 (5), 351 (2) and 61 (2) of the Bharatiya Nyaya Sanhita (BNS) for extortion, criminal intimidation and criminal conspiracy.

Mittal said in his complaint that he has been a BJP worker for a long time and has served as the Chairman of the special publicity cell of the Haryana government.

He alleged that on 9 September, 2024, he received a phone call in which he and Badoli were threatened. “When I confronted the callers, they threatened me, saying that I should meet them or else they would falsely implicate me and Badoli in a case. They also said that if I did not arrange a meeting between them and Badoli, I would also be framed in a false honeytrap,” read Mittal’s complaint.

Mittal further alleged he was threatened again the next day, with the callers warning him of grave consequences if he did not arrange their meeting with Badoli and facilitated a monetary settlement.

Before this, on 1 September, 2024, Bindal had also allegedly given him a similar threat. Mittal also claimed that the accused, along with other unidentified individuals, tried to intimidate him by showing up at his house.

He added that on 14 September last year, he had filed an online complaint with the Director General of Police (DGP) Haryana, and had also sought a meeting. Later, on 18 September, after being blackmailed and threatened again, he had reported the incident to the Sector 5 Police Station in Panchkula, and also informed the police via the 112 emergency helpline.

This was after the accused women, accompanied by some men, had allegedly reached his house, which was under construction at the time.

Mittal said that when the police arrived at the scene, they asked the women causing the disturbance to come to the police station, but they refused and fled. Mittal claimed that he has the call recordings in possession.

According to the complaint, when the accused failed in their attempt to trap him, they allegedly lodged a false case against him and Badoli at the Kasauli Police Station.

ThePrint attempted to reach Rupesh Chaudhary, Station House Officer of Panchkula’s Sector 5 Police Station, for a comment, but the calls went unanswered.

Reacting to the extortion complaint, Jagmati Sangwan, vice president of the All India Women’s Democratic Association (AIDWA), said that BJP’s top leadership has always been seen protecting the leaders involved in crimes against women.

“If this was a case of honey-trapping, were Badoli and Mittal sleeping earlier? Did he (Badoli) ever say that he was being honey-trapped? And, if he was being blackmailed, what was the reason behind it? Can a common woman blackmail the state president of the ruling party?” she remarked.

Sangwan added that had the BJP acted against Badoli after the registration of FIR against him, and the Himachal Pradesh Police taken timely action, they would not have found the opportunity to file an FIR against the complainant.

The woman now booked for extortion had lodged an FIR at the Kasauli Police Station on 13 December, 2024, in which she had alleged that Badoli and Mittal had forced her to consume alcohol, and then raped her in a hotel in Kasauli in July 2023.

She had also claimed that they had recorded compromising videos and photos of her. Badoli and Mittal were booked under Sections 376D (gang rape) and 506 (criminal intimidation) of Indian Penal Code.
