Bulldozers For The Poor, Silk Gloves For The Rich: Inside The Multi-Crore ‘Illegal’ Empire of Gurugram’s Garden Estate RWA

While Gurugram’s civic authorities aggressively dispatch heavy bulldozers to crush
unauthorized roadside kiosks and small shanties in the name of the law, a staggering double standard is playing out just a few kilometers away. In the ultra-premium society of GardenEstate in DLF phase 3, a far more massive illegality is allegedly thriving out in the  open.

How does a luxury housing society operate without a final Occupation Certificate (OC), harbor illegal multi-story expansions, and allow an officially discredited governing body to control crores of rupees in land compensation funds? The answer seems to lie in a toxic cocktail of high-profile influence, legal maneuvering, and systemic blindness. The Illusion of Legitimacy: An "Illegal" Governing Body. At the heart of the controversy is the current Resident Welfare Association (RWA) management.

According to an official, hard-hitting report submitted by the District Registrar of Gurgaon, the current governing body has completely failed to comply with the Haryana Registration and Regulation of Societies (HRRS) Act, 2012. The report explicitly notes that the body’s elections were never approved by the state registrar,concluding that the management "cannot be treated as legally constituted." Yet, despite this report on legal validity this unauthorized group continues to run the premium society as its personal fiefdom.

The defiance reached a boiling point on January 27, 2026. Recognizing the persistent non-
compliance and structural anarchy, the District Registrar took the unprecedented step of
appointing an independent government Administrator to take over the society, dissolve the
RWA’s powers, and mandate entirely fresh elections. However, instead of stepping down, the well-connected management utilized its immense resources to secure a temporary stay on the Administrator’s appointment from the State Registrar in Chandigarh.

While granting the stay, the State Registrar demanded a report. That report—obtained through a Right to Information (RTI) application—unequivocally reiterates that the body running the estate is entirely illegitimate. This unauthorized governing body currently retains physical control over a massive financial corpus, which includes crores of rupees received as government compensation for land.

With no legal status, the oversight of these vast funds remains shrouded in secrecy, raising
urgent questions regarding financial mismanagement and the lack of accountability.
But the violations don’t stop here.

The society is currently harboring rampant, unauthorized structural alterations.
Powerful and influential individuals within the power structure have bypassed strict Haryana
building bylaws to construct illegal extra floors.

Remarkably, these expansions are happening in a society that entirely lacks a final Occupation Certificate (OC). Under standard Gurugram civic laws, operating without an OC or constructing unauthorized floors triggers immediate sealing, heavy penalties, or demolition. Yet, inside the gates of Garden Estate RWA, internal complaints are allegedly suppressed, and external regulatory authorities look the other way. Why is the Law Blind in Garden Estate RWA?

The stark contrast in how the law is applied in Gurugram is impossible to ignore. A small-time vendor trying to make a living on the roadside is met with immediate, unyielding bulldozer action. Meanwhile, illegal governing body controlling crores in compensation without being answerable to anyone. Is influence a shield that permits total immunity from the law? As the RTI-backed reports lay bare the systematic mismanagement in Garden Estate, the question shifts to the state regulators: Will the law finally step in, or will the well-connected continue to operate their unregulated
empire with impunity?
