Excellent write up on freedom of expression and approach to sedition. However, the question pertinent to common mind is “when does sedition starts and where does freedom of expression ends”. As I wrte this comment, should my criticism of govt enable the laws of infringement to curtail my freedom of expression? Where does the views of people Kanhaiah Kumar and his associates of JNU end up?
At one end, for media and selected people, these students have uninfringed right to their expression. On the other hands, for those who are branded as nationalists, these students inciting violence and are making way for working against govt and also attacking the unity of country.
Does this qualify as infringement on their rights or to be tried as sedition for inciting violence to break the country? It is like your freedom of expression trespasses my right to privacy, when it involves me.
I am waiting for a particularly egregious instance of misuse of the sedition law – say against a Roti namak journalist – to utterly shock the conscience of the apex court and for it to read down the Section.
