Judge Yashwant Varma filed a plea in the Allahabad High Court, challenging the constitutionality of the impeachment proceedings against him in connection with the cash row.
A motion for the removal of a judge has to be signed by not less than 100 MPs in Lok Sabha & 50 in the Rajya Sabha. The motion is likely to be brought in the Lower House.
Standing committee on law & justice met 24 June & discussed the issue even as Justice Yashwant Varma faces potential impeachment. Panel will hold more deliberations before finalising recommendations.
The 3-member panel of Chief Justices of Punjab & Haryana HC and Himachal Pradesh HC and a Karnataka HC judge found Varma's misconduct "serious enough" for his removal.
Standing Committee on Personnel, Public Grievances, Law & Justice will sit for discussion on 24 June. Members of the 31-member panel include Ranjan Gogoi, Vivek Tankha, & A.Raja.
Kapil Sibal said that removing Justice Yashwant Varma based on the SC's in-house report will be an indirect way of controlling the judiciary & would endanger judicial independence.
‘The impeachment motion against Justice Yashwant Varma is a matter related to corruption in the judiciary...So, we would like to have a united stand,’ added Union Minister Rijiju.
