The top court refused to accept Delhi gang-rape convict Vinay Sharma's contention that the President did not apply his mind while rejecting the mercy plea.
Vinay Sharma, a 16 December convict on death row, had filed a mercy petition on 29 January before the President who rejected it on MHA's recommendation.
Sharma is one of the four men facing the gallows in the 2012 gang-rape and murder case. He had filed the mercy petition before President Ram Nath Kovind on 29 January.
Additional Sessions Judge Dharmendra Rana said courts can’t afford to discriminate against any convict, including death row convicts, in pursuit of his legal remedies.
