EC officials may be booked under murder charges, says Madras HC on election rallies

Criticising the poll body for allowing campaigns and elections amid the Covid crisis, the court warned that it would not hesitate to stop counting of votes on 2 May.

Chennai: The Madras High Court on Monday came down hard on the Election Commission and called it the “the most irresponsible institution” for the alleged spread of the second wave of Covid-19 in the country.

In stinging remarks, the court said EC officials may be booked under murder charges too.

The first bench of Chief Justice Sanjib Banerjee and Justice Senthilkumar Ramamoorthy made the observation on a public interest writ, seeking for a direction to authorities to ensure fair counting of votes on May 2 in Karur by taking effective steps and proper arrangements with Covid-19 protocols.

Since as many as 77 candidates are contesting in the Karur constituency, it would be very difficult to accommodate their agents in the counting hall. It may affect observance of the protocols, the petitioner alleged.

When the counsel for the EC told the judges that all necessary steps were underway, the bench retorted that by allowing the political parties to take out rallies and meetings, it had paved the way for the resurgence of the second wave of Covid-19.

The judges also orally warned that they would not hesitate to stop the counting of votes on May 2.

  1. The court also should make comment that some chief ministers of non bjp states may be booked under murderous charge as they did not act even though centre did advise them in December 2020 and also sanctioned money for oxygen plants.

  2. It is great that a Few Judges in ALLAHABAD MADRAS HIGH COURTS express their Judgement According to Law and their conscience. SADLY SC IS FULL OF CAGED PARROTS WHO JUST READ JUDGEMENT DRAFTED BY BJP/RSS.MODI AND SHAH ARE PRIME ACCUSED IN SPREADING CORONA.AS THEY MOBILISED MILLIONS TO LISTEN TO THEIR FALSEHOODS. COUNTRY AND WORLD RECOGNISE THEIR DESPERATE EFFORTS TO GRAB POWER EVEN IF HUNDREDS LOOSE LIVES IN THIS MISSION. FALSE DATA ON DEATH,AMOUNT SPENT AMOUNT COLLECTED ID MODI.MODERN DAY SAKUNI,RAVANA.

  3. It is time for India to reorganize courts to get better delivery of justice. These judges like Banerjee etc. should be forced to retire. They can be good Shayars. Court need balanced mind, not emotional mind of Shayars. These city high courts should be replaced with state high courts and new judges. These old geezers should be pensioned off.

  4. this is an irresponsible statement by the judge. he is talking about another constitutional authority. he is only a high court judge. not god. i hope SC takes congnizance of such statement.

  5. What is going on in Judiciary? I have expressed deep anguish in the past as well. In recent days I have seen Judges of High Court use terms like ‘latka Denge’, officials ko ‘Hang kar denge’. In UP these judges imposed a lockdown! Thankfully SC intervened quickly in that matter. Regardless of which side of the political spectrum one sits, this must be causing lot of concern in all circles! Judges are supposed to interpret the law! Thats it. They are NOT THE KEEPERS OF A NATIONS CONSCIENCE. It is the nation itself and its people and its elected Govts at Centre and Federal level which are responsible for that. How can Judges hand Election Commission officials? Is there Law in this country or not? EC is a constitutional authority. Did EC know that there would be a 2nd wave? Did UK know there would be a 2nd wave? Should UK Courts hang UK Executive? Kya ho gaya hai Judiciary ko? I may like Modi OR I may like Rahul Gandhi OR I make like Sharad Pawar, that my choice. But they are my elected leaders. Not these judges. Media is also responsible for making these Judges larger than life. ‘Today High Court has scolded Kejriwal’….Today High Court has scolded Nitish Kumar…what is this? Are Kejriwal and Nitish Kumar kindergarten children, who these judges are scolding? Who told the judges that they are higher placed in constitution that kejriwal or Nitish? I again say that Parliament, Executive, Judiciary all are relevant in only their own roles. India is a welfare state. All Govts are doing what they can to tackle this crisis whether its Maharshtra OR UP OR Centre. This kind of Judicial activism is very very dangerous. High Court is NO ONE to hang/ punish EC. EC did not know that there will be a 2nd wave of this magnitude. No one did.

  6. It is time to tell this high courts to tell it is beyond their juridiction. EC is not responsible or accountable to lower courts. Only supreme courts has juridiction. So stop talking nonsense. India is not ancient Israel. Judges are not appointed by god . This Banerjee & Murthy seems like hangover from from past, Indian version of Samson.
