UP Police files FIR over conspiracy to trigger caste-based violence in Hathras

New Delhi: The Hathras Police has filed an FIR in a case of conspiracy to instigate riots along caste lines in connection with the death of a Dalit woman who was assaulted and allegedly gang-raped by four upper caste men.

The FIR was filed at the Chanda Police Station Sunday.

Sources in the UP Police told ThePrint there was a conspiracy afoot to “defame” the Yogi Adityanath government.

In an interview to ANI, Uttar Pradesh CM Yogi Adityanath said, “Our opponents are conspiring against us by trying to lay a foundation for caste & communal riots through international funding. For last one week, opposition parties were keen to see riots. We need to move forward amidst all these conspiracies.”

Another FIR had been filed Saturday in Lucknow on the basis of a Facebook post by a user who goes by the name of “Munna Yadav”.

On 29 September, the Dalit woman from Hathras succumbed to her injuries at Delhi’s Safdarjung Hospital. She was then cremated early morning on 30 September. The woman’s family claimed that the cremation was done against their wishes, while the police said they carried out the last right “as per the wishes of the family”.

Congress leaders Rahul and Priyanka Gandhi, as well as Bhim Army Chief Chandrashekhar Azad met the victim’s family Saturday.

What the FIRs say

The FIR by the Hathras Police has been registered against “unknown” persons under sections 124A (sedition), 505 (intending to cause public alarm and inducing someone to commit offence against state or public tranquility), 153A (promoting enmity between different groups) of the Indian Penal Code.

According to the FIR, the police have further invoked section 67 (transmitting obscene material in electronic form) of the IT Act, according to the FIR. The FIR mentions 19 charges under the Indian Penal Code (IPC).

A police officer told PTI that the Uttar Pradesh government’s statements and facts related to the Hathras incident were being manipulated and circulated on social media. And that investigation was underway.

The FIR filed in Lucknow Saturday was registered under sections 153 A (promoting enmity between different groups on grounds of religion, race, place of birth, residence, language), 420 (cheating and dishonestly inducing delivery of property), 465 (forgery), 500 (defamation), 505 (statements conducing to public mischief) of the IPC and sections of the Information Technology (IT) Act and the Copyright Act
