Palghar, Jul 30 (PTI) A Motor Accident Claims Tribunal (MACT) in Maharashtra’s Thane has awarded a compensation of over Rs 20 lakh to a man who suffered 64 per cent permanent partial disability in a road accident nearly 15 years ago.
In the order delivered on July 22, the tribunal directed car owner Uttam Ramesh Pimple and the New India Insurance Company Ltd to jointly pay Rs 20.45 lakh to applicant Rohit Vishnu Pardeshi, who was 16 years old at the time of the crash.
Considering that the car was driven by a minor without a driving licence at the time of the accident, the court held that the vehicle owner had breached the insurance policy. Consequently, the tribunal ordered the insurance company to pay the compensation amount to the claimant first and subsequently recover it from the vehicle owner.
The claim against the stationary truck involved in the crash and its insurer was dismissed after the tribunal concluded that the truck driver was not negligent.
According to the petition, on August 11, 2011, Pardeshi was traveling in a car from Mahim to Manor in Palghar district, when the vehicle collided with a stationary truck.
Pardeshi suffered severe head injuries and fractures, falling into a comatose state. He underwent multiple surgeries and intensive medical treatment across various hospitals.
Evaluating the extent of disability and financial loss, the tribunal said, “In light of the available evidence on record, it will be proper to conclude that the applicant has sustained permanent partial disability to the extent of 64 per cent.” On the computation of loss of income, the tribunal noted that the applicant subsequently secured a job under the handicap quota in the Brihanmumbai Municipal Corporation (BMC) in October 2017. Therefore, loss of income was granted strictly for the intervening period between the date of the accident and his employment.
The awarded sum of Rs 20,45,441 includes, Rs 6,49,441 towards hospital bills, Rs 11,10,000 for loss of income during the treatment and recovery period, Rs 50,000 for pain and suffering, along with other non-pecuniary heads.
The tribunal directed the insurance company to deposit the compensation amount in court within two months. PTI COR NP
