that has been hanging fire for the past couple of years ? The Ministry has been unduly marking time over it to fancy advantage guided by certain political considerations !
Justice Gogoi’s elevation itself shows that things are on the mend. There has been a tremendous concentration of power, which has not converted into any worthwhile achievements. The judiciary, though a little malleable during CJI Dipak Misra’s tenure, has weathered the storm. If one sees the quality of discretionary appointments over the last few years, there was absolutely no justification for seeking to take away the power to appoint judges from the Collegium. It is already improving its working, seeking to become more transparent. The Memorandum of Procedure is an unnecessary irritant that should be allowed to fade away. The higher judiciary is one institution that is credible, delivering despite several constraints. Amidst a drought of anything worthwhile to show for time gone by, it should be left in peace. Personally I don’t expect any miracles on pendency. Wishing Chief Justice Ranjan Gogoi a distinguished tenure.
