New Delhi: The Supreme Court has taken note of news reports about controversial remarks made by Allahabad High Court judge Shekhar Kumar Yadav at an event organised by the legal cell of the Vishwa Hindu Parishad (VHP) on Sunday.
“The details and particulars have been called from the High Court and the matter is under consideration,” read a statement issued by the apex court.
At the VHP event, Justice Yadav said he felt no hesitation in saying that the country will function as per the wishes of the majority. “I have no hesitation in saying that this is Hindustan, this country would function as per the wishes of the bahusankhyak (majority) living in Hindustan. This is the law. You can’t say that you are saying this being a High Court Judge. The law, in fact, works according to the majority.”
ThePrint reported how the sitting judge also said at the VHP event that while children in one community were taught tolerance and kindness, in another community, “children are shown slaughter of animals since childhood”, so how can they be expected to be kind and generous.
He further said that one cannot “disrespect a woman who has been given the stature of a goddess” in the Shastras and Vedas, adding: “You cannot say that we have the right to keep four wives, we have the right to give halala, we have the right to pronounce talaq thrice, we have the right to not give maintenance to the wives.”
The judge also used the slur “kathmullah”, saying the country needed to be wary of them as they “are fatal for the country”.
“They are the kind of people who do not want the country to progress, and we need to be cautious of them,” he stated.
Speaking on the topic, “Uniform Civil Code: A Constitutional Imperative”, Justice Yadav also said: “I vow that this country will surely enact a uniform law, and it will happen very soon.”
As demands for his impeachment reverberate, this is not the first time the sitting judge has made provoking comments.
As reported by ThePrint, the judge had proclaimed at the UK House of Lords in September that India was living in its “Amrit Kaal” since 2014, which is when Prime Minister Narendra Modi came to power.
In the Attlee Room speech, where the judge was honoured with the ‘Global Prestige Award 2024’, he further said: “Look at the vision of our Prime Minister, who says within 3-4 years we’ll reach the third spot (global economy), and by 2047, we’d be number 1.”
Justice Yadav, who became a confirmed judge of the Allahabad High Court in March 2021, has previously passed judgements over making cows the national animal, bestowing national honours on deities Ram and Krishna and declaring that when the majority community converts, it weakens the country.
‘No right to sit on that chair’: Sibal
Rajya Sabha MP and senior advocate Kapil Sibal Tuesday said the judge has violated his oath of office by making a “hate speech”, and asserted that he along with other opposition MPs will submit a notice to bring a motion to impeach the judge
“Any judge who makes such a statement is violating his oath of office. If he is violating the oath of office he has no right to sit on that chair,” Sibal said at a press conference.
He further said: “If a high court judge can make a speech like this then the question arises how do such people get appointed in the first place. The question also arises how do they get the courage to make such remarks. Question also arises why these things are happening in the last 10 years.”
