Bill to deny pension for MLAs disqualified for defection introduced in HP assembly

Shimla, Apr 1 (PTI) Himachal Pradesh MLAs disqualified for defection under the 10th Schedule of the Constitution will not be entitled to pensions soon.

Chief Minister Sukhvinder Singh Sukhu on Wednesday introduced a bill to amend the Himachal Pradesh Legislative Assembly (Allowances and Pension of Members Amendment Act.

The bill, which seeks to amend Section 6-B of the Act, states, “Notwithstanding anything contrary to Section 6-B of the Act, a person elected as a member of the 14th state assembly or thereafter shall not be entitled to a pension under the Act if they have been disqualified under the 10th Schedule of the Constitution.” Sukhu said that the amendment was necessary because the Act currently has no provision to discourage defection of MLAs. The bill aims to achieve this constitutional object, safeguard the mandate given by the people, to preserve democratic values and deter constitutional transgression, he said.

During the 2024 Rajya Sabha elections, six MLAs of the ruling Congress had cross-voted in favour of the BJP candidate, leading to their disqualification. PTI BPL RUK RUK
