Allahabad HC dismisses contempt petitions against construction of corridor in Varanasi

Prayagraj, Mar 11 (PTI) The Allahabad High Court has dismissed contempt petitions in a matter pertaining to the construction of a four-lane elevated corridor passing through Varanasi’s Shivpur, allowing the project to go forward.

The order was passed by Justice Rohit Ranjan Agarwal, hearing a contempt application filed by Narayan and others, alleging that the construction of the corridor was in violation of an interim order passed by the same Court in 2013.

Narayan and others had moved the HC, saying that the high court in 2013, while hearing a petition filed by them, granted an interim order restraining any construction over the land, which is a pond land.

When the matter was taken up now, Bipin Bihari Pandey, chief standing counsel, said the applicants themselves have erected constructions, violating the 2013 interim order.

It was specifically provided in the order that no construction was to be made over the land in dispute, Pandey said.

He further informed the Court that an elevated corridor is being made, and out of 25 pillars that have to be constructed, 12 have already been constructed.

According to him, the land over which the elevated corridor is being made is government land, over which the encroachment has been made by the applicants.

“…no case for contempt is made out as it is clear that constructions have been made post 2013, which was prohibited by the writ Court,” the Court observed, dismissing the contempt petition.

As per the case, the petitioners had moved the high court in 2013, challenging an order passed in 1996 by a sub-divisional officer, who had the names of the petitioners expunged from revenue records. PTI COR RAJ AMJ AMJ
