Bulldozers run riot, even after Supreme Court’s detailed guidelines to curb extrajudicial demolitions. Fresh ‘bulldozer justice’ in Uttar Pradesh and Maharashtra symbolises complete disregard of law. State governments are creating their own rulebooks overriding the Constitution. And today’s spectacle-driven politics is managing to escape the might of the court’s hammer.

NJAC not the answer to judicial reform. Don’t replace collegium process with something worse

The case of cash at a Delhi HC judge’s house highlights urgent need for judicial reforms, but NJAC is not the answer. The collegium process to pick judges is least of the imperfect systems. ‘Regaining people’s trust’ can’t be used as a smokescreen to replace it with something much worse.

  1. One observation Justice Arijit Pasayat made has stayed with me. Stopped offering opinions the day I became a Judge. Passed only binding orders.

  2. That is a generous viewing of what is undoubtedly a tough situation. I don’t know if China faced a 1991 style crisis in 1978, although the Great Leap Forward and then the Cultural Revolution exacted a terrible price for ordinary citizens. However, once they started reforming under Deng, there has been no looking back. India was fully capable of doing and achieving what China has since then. An abiding regret that we haven’t.
