Jaipur, Jan 28 (PTI) Rajasthan High Court Chief Justice Pankaj Mithal on Saturday said the rules for open jails vary from state to state and there should be uniform regulations for such facilities.
“There should be detailed discussions on this and there should be uniform rules and regulations for open jails,” he said.
Speaking at an event organised at the Sanganer open jail here by non-profit organisation Prison Aid Action Research (PAAR), Justice Mithal said senior citizens should first be sent to open jails, instead of the regular prisons. First-time offenders and those who do not have a tendency to commit crimes should also be sent to open jails, he added.
Supreme Court judge Justice Sanjay Kishan Kaul, who is also the executive chairman of the National Legal Service Authority, said open jails are like kites, where prisoners can live freely with some strings attached.
He said certain restrictions are imposed on the inmates of an open jail and those who do not follow the rules are sent to regular prisons.
Justice Kaul also suggested measures to the Sanganer open jail authorities, such as having a “pucca” roof and a sewerage line for better living arrangements for the inmates.
“Open jails are like kites where you can fly with some strings attached. It is an arrangement where you can live freely, but with some restrictions,” he said.
Justices Madan B Lokur, MM Srivastava, Ravindra Bhatt, Aniruddha Bose and Sandeep Mehta also expressed their views on the occasion. PTI AG RC
