Maha: MACT awards Rs 19.68 lakh compensation to kin of man killed in motorcycle accident

Thane, Sep 2 (PTI) The Motor Accident Claims Tribunal in Maharashtra’s Thane has awarded a compensation of Rs 19.68 lakh to the family of a 24-year-old man killed in a road accident in 2019.

MACT member HM Bhosale directed respondents in the case including the insurer to make the payment jointly and severally to the petitioners with an interest of 8 per cent per annum from the date of filing of the petition.

In an order passed on August 30, the MACT also directed that Rs 2,000 be paid to the petitioners towards the cost of the petition.

Appearing for the petitioners, advocate S M Pawar informed the tribunal that the victim, Anil Vishe was employed as a cook in a hotel at Murbad and earned Rs 21,000.

On July 19, 2019, Vishe was travelling home on his friend’s motorcycle, when a tempo coming from the opposite direction hit them. The duo fell and sustained injuries, and died while undergoing treatment at a hospital.

Vishe’s family of five were totally dependent on him and sought compensation from the owner of the tempo and the insurer.

The tempo owner did not appear and the matter was decided ex-parte against him, while the insurer, Reliance General Insurance Co. Ltd vehemently opposed the claim on various grounds.

The compensation amount includes Rs 18.14 lakh towards dependency loss, Rs 16,500 each towards loss of estate and funeral expenses, Rs 40,000 towards spousal consortium and Rs 80,000 towards parental consortium. PTI COR ARU ARU
