The entire legal profession has a vested interest in expanding and distorting the law. In the name of interpretation, we have a collegium that isn’t mentioned in the constitution. An amendment to the constitution that was passed after a decade of consultation and approved by an overwhelming majority in the parliament and by two-thirds of the state assemblies was overturned by a handful of unelected judges with a conflict of interest. Is this justice?
Many of the judges are children and relatives of former judges, while nobody knows how judges are selected. There are cases that aren’t heard for decades while others that are heard on a one day notice. By its delays, inconsistent judgments and its conflict of interest, judiciary is the main reason why criminals walk freely, the corrupt aren’t punished and the environmental destruction continues. And now we have one more article from one more lawyer pitting judiciary against other branches. If you don’t like the law, please work hard to change it. The path to hell is paved with good intentions.
You are absolutely right , Sir.But for vested interest, the judiciary would have been a beautiful thing to adore.
though not a legal person i cannot but applaud raju ramachandran for pin pointing a major weakness in the supreme courts approach to human life and liberty.; eg allowing the situation in kashmir to linger in the name of national security or the draconian preventive custody acts etc. . it’s time this bogey of national security is dealt with firmly. every indian is a patriot the same as any other national is patriotic to his own country. just because one disagrees with a particular ideology or a prominent person and holds alternate views does’nt make him a security risk.

First and foremost every citizen is patriot is not fact on ground. Those who are involved in jihadi activity and in cohorts with our west neighbor are definitely not. Regarding JK, supreme Court is right as there is great jihadi threat after Aug decision. Restricted movement, be a law abiding citizens.
