Indian woman engineer alleges workplace bias at Apple over her ‘Hindu ancestry in Pakistan’

Anita Nariani Schulze told a California court that she was forced to quit her Apple job in 2019 after tolerating years of discriminatory treatment by her Indian & Pakistani managers.

San Francisco: Apple Inc. lost an early round in a discrimination lawsuit brought in the U.S. by a female engineer from India who says her two managers — one from her country, the other from Pakistan — treated her as they would in their own countries: as a subservient.

The woman’s case in California state court is the latest to allege workplace bias in Silicon Valley that arises from the prevalent cultural prejudices of tech workers from South Asia. Cisco Systems Inc. is fighting a suit brought by California’s civil rights agency alleging bias against a member of India’s Dalit caste, formerly referred to as the “untouchables.”

Anita Nariani Schulze said she was forced to resign her job as a technical engineer at Apple in 2019 after tolerating years of discriminatory treatment at the hands of her senior and direct managers.

She said the two consistently excluded her from meetings while inviting her male counterparts, criticized her, micromanaged her work, and deprived her of bonuses, despite positive performance evaluations and significant team contributions.

Schulze claimed that part of the managers’ animus against her was due to her Hindu ancestry in Pakistan’s Sindh region, which she said is “known for its technical acumen” and encouragement of “women to rise above their historically subservient gender roles.”

In a tentative ruling on Wednesday, Santa Clara County Superior Court Judge Sunil R. Kulkarni rejected Apple’s request to toss out the suit. While not ruling on the merits of the case, Kulkarni said Schulze had adequately supported her legal claims. Apple had argued her claims weren’t specific enough and were based on stereotypes.

But the judge rejected Schulze’s request to represent a class of female Apple employees who suffered job discrimination over the last four years. He agreed with Apple that she didn’t show a pattern of discrimination that could be applied to a broader group.

It wasn’t clear from the court’s docket whether the judge will hold a hearing Thursday before issuing a final ruling.

Apple didn’t immediately reply to a request for comment.

In the Cisco case, the California Department of Fair Employment and Housing alleged that two Indian employees at the San Jose-based company discriminated against a Dalit co-worker on the basis of caste.

Cisco has denied the claims, insisting it has “zero tolerance for discrimination.” It also said the lawsuit should be tossed out because caste isn’t a protected category under U.S. civil rights law.- Bloomberg

    • Indian women feel too entitled using naari/female-biased laws to destroy male lives inside India. Males are expendable in India. This could just as well be misguided extension of same sense of entitlement happening to Indian women abroad.

      She needs to realize equal treatment does not mean special/discriminatory treatment in her favor. Her own caste/societal biases which she has cultivated might also be in play.

We know Hindus are second grade citizens in Pakistan and face forced conversion abducion rape etc. We have sympathy with them. How could we mistreat?     • However, hindus in Pakistan are much more comfortable than Muslims in India. Forced conversions in Pakistan are seriously tackeld by law enforcement agencies. And no such incidents have taken place recently. But 10 members of Pakistani hindu family were murderd in india recently. What about the brutal killings of innocent muslims on false claims of cow slaughtering while india is biggest exporter of cow meat and ridiculously it has a federal cow ministry. Mass killings of muslims in hindu- muslim riots are dilemma of indian history, no such massive killing of minorities have taken place in pakistan ever. And what about your civil citizenship law that denies even citizenship to millions of muslims? By the way which court of law in the world has ever given a verdict on the basis of 500 year old writings of a voyager, about its not sure whether it belong to him or not and who does not exist to defend his claim even but your supreme court gave his verdict in Barbri mosque case on such grounds, but voyager didn’t claim there was a temple even. Dear problems are everywhere but it doesn’t mean you take them to spread your personal hatred and propaganda. Be realistic.

  17. Some Dalits and the leaders who represent them misuse the current reconciliation efforts through education and job reservation. However a lot of work remains to get them to main stream. Unless the Dalits are exposed to good teachers for 2 generations, their integration will never be complete and they will never be independent of dole outs.

    • Most Muslim managers are totally biased against other religion workers, no work
      ethics. These discriminatory managers whichever religion might be should be kicked out of western country.

    • I do not, which country are you from. But in India, there is hardly any discrimination in corporate sector and large family run businesses. I would not claim that it is only merit, but most of the it is, which is the driving factor in employment and career growth at least to middle levels. At senior levels politics also plays part in career.

  20. This is not new to India, where even in MNC from recruitment, yearly salary hike, awarding employees, promotion bias based on Gender, Caste, skin colour, dressing and language wide spread.

    We have to cross all these hurdles to get recognision. It’s Horrible.
