Courts should decide on merit whether P. Chidambaram deserves bail. If the government has evidence against anybody, it should be investigated. But due process must be followed. It doesn’t help anybody, least of all the cause of justice, if between agencies and the courts an unnecessary political spectacle is created.

  1. Perhaps there is a case to review and codify the law relating to custodial interrogation. Normally one would expect it to be used in cases of violent crime and against hardened criminals. In the Indian context, sustained interrogation is a euphemism for third degree methods. 2. As far as financial crimes are concerned, the case generally rests on documentary evidence. Once all the relevant records are in the possession of the investigating agency, the suspects can be called for questioning during normal working hours. It would be a reasonable precaution to require persons of interest to deposit their passports in the competent court. 3. Once the investigation is completed, the charge sheet can be filed in court and the trial can commence.
